VietNamNet Bridge – An official of the Hanoi Milk JS Company, or Hanoimilk, said the firm would not take legal action against the Health Ministry as some newspapers reported, but he accused the agency of intentionally “distorting” the infection of melamine in the firm’s products.

Farmers sued the Health Ministry. We don’t plan to do so yet. We have to consult our shareholders, but we are not excluding this if we are driven into a tight corner,” said the Vice Chairman of Hanoimilk Board of Directors, Dinh Van Thinh last week.

However, Hanoimilk’s General Director and Chairman Tran Dang Tuan told VietNamNet, on Monday, that the firm does not and will not sue the Health Ministry because the melamine scandal was an “unexpected misfortune.”

But Tuan emphasized that both representatives of the Inspectorate and Food Hygiene and Safety Agency under the Health Ministry released incorrect information and even intentionally “distorted” Hanoimilk’s melamine case.

He said the way the Ministry released information about the melamine case made consumers understand that more testing and more mistakes were found with Hanoimilk’s products. The inaccurate information puzzled consumers and seriously caused losses to Hanoimilk.

After the Health Ministry withdrew its decision to seal Hanoimilk’s two batches of powdered milk imported from China, which was said to contain melamine, only 75 tons of milk was able to be used and the 105 others have expired.

The firm is estimated to have suffered losses of VND 42 billion ($2.47 million) from this case. “That doesn’t include brand-related losses. We cooperated with a South Korean firm to build a factory in HCM City. They stopped cooperation when they heard that our products infected with melamine,” Thinh said.

In October 2008, the Health Ministry announced that some products of Hanoimilk contain melamine. In December, the Ministry stated that the 25 samples of the company’s milk tested negative for the poisonous substance. However, the firm suffered huge losses when it was vindicated.
